Kullanım Koşulları

Loca, İstanbul'daki restoran, bar, kafe ve beach club'ları (“mekan”) içerik üreticileriyle (“üretici”) buluşturan bir platformdur. Bu koşullar, Loca iOS uygulamasını ve getloca.net'i kullanırken geçerlidir. Loca'yı Serkan Hekimoğlu işletir (“Loca”, “biz”). İletişim: support@getloca.net.

1. Loca'nın rolü

Loca, mekanların tekliflerini üreticilerle buluşturur, davetleri ve girişleri kaydeder. Bir ziyaretteki hizmet, ikram ve paylaşım, mekan ile üretici arasındadır; Loca bu ilişkinin tarafı değildir ve mekanın hizmetinden ya da üreticinin içeriğinden sorumlu tutulamaz.

2. Hesap

Hesap yalnızca uygulamada, Apple ya da Google ile girişle açılır. Rolün (üretici ya da mekan) kayıtta seçilir; değiştirmek için destekle yazışman gerekir.
Üreticilerin 18 yaşını doldurmuş olması gerekir. Verdiğin bilgiler doğru ve sana ait olmalıdır; bir kişi ya da mekan tek hesap açar.
Her hesap, kullanılmadan önce ekibimizce incelenir. Başvuruyu gerekçesini bildirerek reddedebiliriz; eksikleri tamamlayıp yeniden başvurabilirsin.

3. Üreticiler

Instagram'da Creator ya da işletme hesabı bağlaman gerekir. Takipçi ve etkileşim bilgilerin mekanlara gösterilir.
Davet isterken mekanın belirttiği gün ve saatlerden birini seçersin. Onaylanan davette o saatte mekanda olursun; gelemiyorsan en geç 6 saat önce uygulamadan iptal edersin.
Girişten sonraki 48 saat içinde mekanın istediği paylaşımı (Reel ya da story) yapar ve bağlantısını uygulamaya eklersin.
Paylaşımlarında iş birliğini açıkça belirtmek (ör. #reklam ya da “iş birliği” etiketi) yürürlükteki reklam mevzuatı gereği senin sorumluluğundadır.
Teklif dışında ekstra talep etmezsin; teklifin dışındaki her şeyin ücreti sana aittir.

4. Mekanlar

Mekanın Instagram işletme hesabını bağlar ve haritada gerçek yerini seçersin. Mekanı temsil etmeye yetkili olduğunu kabul edersin.
Yayınladığın teklifi (ikram, kişi sayısı, gün ve saatler) eksiksiz sunarsın; teklif kapsamındaki hiçbir şey için üreticiden ücret istemezsin.
Girişte üreticinin QR kodunu Loca uygulamasıyla okutursun; giriş, cihazının konumu mekana yakınsa kaydedilir.
Güvenli ve saygılı bir ortam sağlarsın.

5. Paketler ve ödeme

Mekanlar teklif yayınlamak için aylık paketlerden birini App Store üzerinden satın alır. Ödeme, yenileme, iptal ve iadeler Apple'ın koşullarına tabidir; aboneliği App Store hesabından yönetirsin.
Abonelik, dönem bitiminden en az 24 saat önce iptal edilmezse otomatik yenilenir. Her onaylanan başvuru, paketteki aylık iş birliği hakkından birini kullanır; kullanılmayan haklar sonraki aya devretmez.
Paket yükseltmeleri hemen, düşürmeleri bir sonraki yenilemede geçerli olur.
Kurucu mekanlara verilen teklif kodları Apple'ın teklif kodu koşullarına tabidir.

6. İçerik

Paylaşımların telif hakları üreticiye aittir. Mekan, paylaşımı Instagram'ın kendi araçlarıyla (ör. etiketlendiği paylaşımı hikayesinde göstermek) yeniden paylaşabilir; reklam ya da başka mecralarda kullanmak için üreticiden ayrıca izin alır. Uygulamaya yüklediğin fotoğrafların sana ait olduğunu ya da kullanma hakkın bulunduğunu kabul edersin.

7. Kurallar ve ihlaller

Onaylı davete gelmemek, 48 saat içinde paylaşmamak ya da ekibimizce haklı bulunan bir şikayet bir ihlal sayılır. İki ihlalde hesap askıya alınır.
Sahte hesap açmak, başkasının yerine hareket etmek, taciz, ayrımcılık, para ya da karşılık talep etmek ve yasa dışı her türlü davranış yasaktır. Bu durumlarda hesabı uyarısız askıya alabilir ya da kapatabiliriz.

8. Hesabın silinmesi

Hesabını uygulamadan (Profil ya da Rapor › Hesabımı sil) silebilirsin. Önce açık işlerini kapatman gerekir: mekanlar yayındaki tekliflerini kaldırır ve onaylı ziyaretlerin tamamlanmasını bekler; üreticiler bekleyen isteklerini geri çeker, onaylı davetlerini iptal eder ve borçlu oldukları paylaşımları gönderir. Askıya alınmış hesaplar bu koşul olmadan silinebilir.

9. Sorumluluğun sınırı

Loca'yı “olduğu gibi” sunarız. Kesintisiz ya da hatasız çalışacağını garanti etmeyiz. Yasaların izin verdiği ölçüde; mekandaki hizmetten, ulaşımdan, üretici içeriğinden ya da taraflar arasındaki anlaşmazlıklardan doğan zararlardan sorumlu değiliz. Tüketici olarak yasal haklarını bu koşullar sınırlamaz.

10. Değişiklikler, hukuk

Koşulları değiştirebiliriz; önemli değişiklikleri uygulamada ya da bildirimle duyururuz. Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır; uyuşmazlıklarda İstanbul mahkemeleri ve icra daireleri, tüketiciler için yasal tüketici hakem heyetleri ve tüketici mahkemeleri yetkilidir.

Loca connects restaurants, bars, cafés and beach clubs in Istanbul (“venues”) with content creators (“creators”). These terms apply when you use the Loca iOS app and getloca.net. Loca is run by Serkan Hekimoğlu (“Loca”, “we”). Contact: support@getloca.net. The Turkish text above prevails.

1. Loca's role

Loca matches venues' offers with creators and records invites and check-ins. The service, hospitality and posts of a visit are between the venue and the creator; Loca is not a party to that relationship and isn't responsible for the venue's service or the creator's content.

2. Your account

Accounts are created in the app only, with Apple or Google. You choose your role (creator or venue) at sign-up; changing it needs support.
Creators must be 18 or older. Your details must be accurate and your own; one account per person or venue.
Our team reviews every account before it can be used. We may reject an application with a reason; you can fix it and apply again.

3. Creators

You connect an Instagram Creator or business account. Your followers and engagement are shown to venues.
You request a time within the venue's days and hours, show up for approved invites, and cancel in the app at least 6 hours ahead if you can't make it.
Within 48 hours of check-in you share the post the venue asked for (Reel or story) and add its link in the app.
Clearly marking the collab in your posts (e.g. #ad or a “paid partnership” label) is your responsibility under advertising law.
You don't ask for extras; anything beyond the offer is on you.

4. Venues

You connect the venue's Instagram business account, pick its real place on the map and confirm you may act for the venue.
You deliver the published offer in full and never charge the creator for anything it covers.
At the door you scan the creator's QR code in Loca; the check-in counts when your device is near the venue.
You provide a safe and respectful environment.

5. Packages and payment

Venues buy a monthly package through the App Store to publish offers. Payment, renewal, cancellation and refunds follow Apple's terms; you manage the subscription in your App Store account.
Subscriptions renew automatically unless cancelled at least 24 hours before the period ends. Each approved request uses one of the package's monthly collabs; unused collabs don't carry over.
Upgrades apply at once, downgrades at the next renewal. Founding-venue offer codes follow Apple's offer code terms.

6. Content

Creators own the copyright of their posts. A venue may reshare a post with Instagram's own tools (e.g. showing a post it's tagged in on its story); any other use, such as ads, needs the creator's permission. You confirm you own or may use the photos you upload.

7. Rules and strikes

A no-show for an approved invite, no post within 48 hours, or a complaint our team upholds is a strike. Two strikes suspend the account.
Fake accounts, impersonation, harassment, discrimination, asking for money or favours and anything illegal are not allowed; we may suspend or close the account without notice.

8. Deleting your account

You can delete your account in the app. First close what's open: venues remove live offers and wait for confirmed visits to finish; creators withdraw pending requests, cancel approved invites and send posts they owe. Suspended accounts can be deleted without this.

9. Liability

Loca is provided “as is”, without a promise of uninterrupted or error-free service. As far as the law allows, we aren't liable for the venue's service, travel, creators' content or disputes between members. Your statutory consumer rights are not affected.

10. Changes and law

We may change these terms and will announce important changes in the app. Turkish law applies; Istanbul courts are competent, and consumers keep access to consumer arbitration committees and consumer courts.
